Terms of Use

These Terms of Use ("Terms") constitute a legal agreement between you ("User", "you") and QR Code Scanner Pro ("Company", "we", "our", or "us") regarding your access to and use of the QR Scanner ProMax mobile application (the "App") and its related services ("Services").

By clicking "Accept", downloading, installing, or using the App in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms as well as our Privacy Policy. If you do not agree to these Terms, you must not use the App and must immediately uninstall it from your device.

1. Entire Agreement

These Terms represent the entire agreement between you and the Company regarding your use of the App, superseding any prior agreements or understandings. We may amend these Terms at any time, at our sole discretion, without prior notice. Any updated version will take effect immediately upon being posted within the App. Your continued use of the App after changes are made constitutes your acceptance of the updated Terms. If you do not agree with any amendments, you must stop using and uninstall the App.

2. Modification and Termination

We reserve the right, at any time and for any reason, to modify, suspend, discontinue, or terminate the App, or any part thereof, without prior notice. We may also terminate or restrict your access to the App at our discretion, with or without cause or notice. You acknowledge that we are not liable for any such modification or termination. Upon termination, any licenses granted to you under these Terms shall immediately cease, and you must uninstall and discontinue all use of the App.

3. Using This App

• The App is designed to block ads on your device. However, we do not guarantee uninterrupted or error-free operation, nor do we warrant that the App provides full protection against ads or any threats. Your use of the App is entirely at your own risk.
• We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Upon installation, an icon may be placed on your device's home screen. You may uninstall the App at any time via your device settings or the in-app uninstall feature.
• Paid subscriptions made via in-app purchases can be canceled or refunded directly through Apple or Google:

• We may periodically release updates or upgrades. You consent to receive such updates automatically. Updates may be mandatory, and failure to install may result in termination or limited performance of the App.

4. License Grant

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on a single device that you own or control. Any use of the App not expressly authorized by these Terms is prohibited and may violate applicable laws. Unauthorized use will result in immediate termination of this license.

5. Limitations

You agree not to, nor permit others to:

• Use the App for unlawful or prohibited purposes.
• Violate any applicable laws or third-party platform policies.
• Copy, distribute, sublicense, sell, or commercially exploit the App.
• Use data mining, scraping, or similar data gathering tools.
• Modify, reverse engineer, decompile, or disassemble the App.
• Bypass technical protections or limitations within the App.
• Create derivative works based on the App.
• Use the App to compete with or replicate similar services.

6. User Representations and Warranties

By using the App, you represent and warrant that:

• You are authorized to use the App and any related services or content.
• You assume all risks and responsibilities related to your use of the App.
• You are at least 18 years of age, or have obtained legal parental consent if required.
• If using the App on behalf of an entity, you have full authority to bind such entity to these Terms.
• You will comply with all applicable laws and regulations in your use of the App.

7. Third-Party Content and Services

The App may provide links or access to third-party content, services, or platforms ("External Services"). We do not control or endorse any External Services, nor are we responsible for their content, policies, or practices. You interact with such third parties at your own risk and are solely responsible for reviewing their terms and conditions before engaging with them. We disclaim any liability arising from your interaction with any third party.

8. Intellectual Property

We retain full ownership of all intellectual property rights related to the App, including copyrights, trademarks, trade secrets, patents, and proprietary content. You may not copy, modify, distribute, or otherwise use any part of the App except as expressly authorized for personal, non-commercial purposes.

9. Warranties and Liability

• The App and Services are provided "as is" without any warranties, either express or implied.
• We do not warrant uninterrupted, accurate, secure, or virus-free operation of the App.
• Your sole remedy for dissatisfaction is to cease using and uninstall the App.
• To the fullest extent permitted by law, we and our affiliates shall not be liable for any indirect, incidental, consequential, or special damages, even if we have been advised of the possibility of such damages.
• Our maximum aggregate liability shall not exceed the amount you paid us in the three months prior to the claim or the minimum permitted by law.
• You agree to indemnify us against any losses or claims resulting from your violation of these Terms or misuse of the App.

10. Governing Law and Jurisdiction

These Terms are governed exclusively by the laws of Cyprus, without regard to conflict of laws principles. Any disputes shall be resolved solely by the competent courts of Israel. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

11. Reporting Violations

You agree to promptly report any violations of these Terms or unauthorized use of the App and to fully cooperate with us in any investigation or remedial efforts.

12. Notices

All notices must be submitted to us in English via email at: [email protected]. Notices sent to any other address or format will not be accepted. Translated documents must include notarized certification. We may request additional information to process your notice.

13. Waiver and Severability

Our failure to enforce any provision shall not constitute a waiver of any rights. If any part of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. Survival

Upon termination of these Terms, all rights granted to you will immediately cease. Provisions regarding limitation of liability, indemnification, and intellectual property shall survive termination.

15. Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may freely assign or transfer these Terms. These Terms are binding upon and will inure to the benefit of our successors, affiliates, and assigns.
